In this paper, the author deals with the right to take annual leave by state, public and local servants and employees in state bodies, public institutions or services and in administrative bodies of the units of local and regional self-government; it also deals with the right to annual leave of elected officials in the local self-government units, i. e. of municipal chairmen, mayors, prefects and the mayor of the City of Zagreb, who perform their duties professionally.

The right of the above employees and servants to take annual leave, and its duration, is not regulated by special laws which regulate their rights and obligations, such as the Civil Servants Act, Act on Wages in Public Services and the Act on Civil Servants and Employees in Local and Regional Self-Government, but is regulated, on the basis of the minimum duration of annual leave as prescribed in the Labour Act, by autonomous sources of law, i. e. employment contract, company by-law and collective agreement.
